The first thing to know about owing the State of Mississippi back taxes is that you need to begin making payments as soon as possible, even if you don’t have a formal payment plan.  Pay as much as you can as early as you can,because once the State issues a levy or garnishment, it’s more difficult to get a resolution in place.

Individual Tax

If you are filing a return with a balance due, send in the installment agreement Form 71-661 with it to request a monthly payment plan.  This form only works if you are filing a timely return and the total tax owed is more than $75 but not more than $3,000.  Here are some other conditions.

  • You need to have a clean record for the past 5 years.  That means you’ve been a good taxpayer, filing and paying all taxes on time.
  • You get 12 months to pay from the time the return was filed.
  • You need to comply with the terms of the agreement – making monthly payments on time and maintaining current tax compliance.

If the terms above aren’t for you, you may have to resort to the business guidelines below. 

Business Tax

The standard terms for a business tax liability are 1/3 down, and 6 months to pay the remaining balance.

Installment agreements with better terms are not available as formal agreements.  You may be able to get an informal arrangement to pay if you provide financial information to prove your inability to pay quicker, get approval from management and beg a little.  If you do get an informal payment arrangement, you will not be protected from enforced collection actions such as levies and liens.

Penalty Relief
